(June\u00a018,\u00a02026) \u2014\u00a0As the growing\u00a0data center industry\u00a0sparks concerns for\u00a0consumers, environmentalists, and communities across the state,\u00a0Democratic legislators\u00a0introduced legislation\u00a0today,\u00a0spearheaded by\u00a0Sen. <\/span><b>Rosemary Bayer <\/b><span>(D-West Bloomfield),\u00a0to\u00a0ensure the sustainable development of these facilities\u00a0and protect\u00a0Michigan ratepayers, workers,\u00a0and\u00a0natural\u00a0resources.\u00a0<\/span><\/p>\n<p><span>\u201cWith the astronomical rates of electricity and water that large-scale data centers consume, Michiganders are understandably\u00a0concerned about the prospect of these\u00a0developments\u00a0coming to\u00a0their community,\u201d said Sen. <b>Bayer<\/b>. \u201cI\u2019m proud to introduce legislation that responds to these concerns, taking a multi-pronged approach\u00a0that protects Michigan workers and ratepayers while mitigating the impact on our\u00a0state\u2019s\u00a0cherished natural resources.\u201d<\/span><\/p>\n<p><span>Also\u00a0sponsored\u00a0by Sens. <b>Mallory McMorrow <\/b>(D-Royal Oak),<b>\u00a0Kevin Hertel<\/b>\u00a0(D-St. Clair Shores), and <b>Darrin Camilleri<\/b>\u00a0(D-Trenton),\u00a0this legislative package\u00a0would:<\/span><\/p>\n<p><span><\/span><\/p>\n<ul>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<div class=\"elementToProof\" role=\"presentation\">Senate Bill\u00a01046\u00a0(<b>BAYER<\/b>):\u00a0Establish\u00a0permitting requirements and public hearing guidelines for individuals who use over\u00a0550,000 gallons\u00a0of water per day for consumptive use. It also\u00a0enables the Michigan Dept. of Environment, Great Lakes, and Energy (EGLE) to\u00a0monitor\u00a0wastewater discharged from\u00a0data centers.<\/div>\n<\/li>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<div class=\"elementToProof\" role=\"presentation\">Senate Bill\u00a01047\u00a0(<b>MCMORROW<\/b>):\u00a0Ensure\u00a0Michigan\u00a0residents and businesses\u2019\u00a0electricity\u00a0bills and service would not be\u00a0impacted,\u00a0require utilities to create a separate rate class for large-load customers,\u00a0ensure they\u00a0use\u00a0clean energy,\u00a0and\u00a0limit\u00a0operations during\u00a0an\u00a0energy\u00a0emergency.<\/div>\n<\/li>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<div class=\"elementToProof\" role=\"presentation\">Senate Bill 1048 (<b>HERTEL<\/b>):\u00a0Create labor protections for data center development, such as ensuring a union wage is paid, and a labor or collective bargaining agreement is made for the construction and operation of the facility.<\/div>\n<\/li>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<div class=\"elementToProof\" role=\"presentation\">Senate Bill\u00a01049\u00a0(<b>CAMILLERI<\/b>):\u00a0Prohibit public employees and public officers from entering into non-disclosure agreements\u00a0with data centers\u00a0under certain conditions.<\/div>\n<\/li>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<div class=\"elementToProof\" role=\"presentation\">Senate Bill 1050-51 (<b>CAMILLERI<\/b>):\u00a0Require an agreement\u00a0between data center owners\u00a0or operators\u00a0and the local community prior to construction, ensuring\u00a0the facilities will\u00a0benefit\u00a0residents\u2019\u00a0health, safety, and general welfare, as well as the\u00a0natural resources that surround them.<\/div>\n<\/li>\n<\/ul>\n<p><span>\u201cData centers are\u00a0going up\u00a0across the country faster than people can keep up. The question is whether Michigan sets the terms, or whether someone else sets them for us,\u201d said <\/span><b>McMorrow<\/b><span>. \u201cMy colleagues and I have spent months listening to constituents across this state, and the message is the same everywhere: they\u2019re worried about their energy bills, their water, and the sense that decisions this big are being made to their communities instead of with them.\u00a0So\u00a0we drew a hard line. Under my bill, no Michigan resident will pay a single cent more because a data center came to their community. Period. The companies cover the full cost of their projects \u2014 whether they last or not, they pass a thorough review before breaking ground, and they ramp down during peak demand without firing up diesel generators.\u201d<\/span><\/p>\n<p><span>\u201cTechnological advancement is inevitable, but whether it comes at the expense of our communities and environment is up to us. Here in Michigan,\u00a0we\u2019re\u00a0choosing to build the economy of the future in a way that safeguards our environment and ensures working people share in its success,\u201d said Sen. <b>Hertel<\/b>. \u201cWith this legislation, we\u2019re proving that business and environmental interests do not have to be competing\u00a0priorities, but\u00a0can work together to create communities with access to fresh air, clean water, and good-paying jobs that allow the benefits of these projects to reach the middle-class families whose hard work makes this progress possible.\u201d<\/span><\/p>\n<p><span>\u201cThe people of Michigan deserve not only to know the details of these deals, but also to share in the benefits they create,\u201d said Sen. <b>Camilleri<\/b>. \u201cMy bills accomplish both goals by prohibiting public officials from signing non-disclosure agreements that keep communities in the dark about these projects, while also requiring tech companies to enter into community benefit agreements that ensure local residents see real investments and opportunities in return.\u201d<\/span><\/p>\n<p><span>This legislation\u00a0builds on\u00a0the\u00a0previous\u00a0efforts of other Democratic senators to regulate the swiftly growing hyperscale data center industry in Michigan.
