LANSING, Mich. (<\/span>March\u00a0<\/span><\/span>2<\/span>, 202<\/span>3<\/span>)\u00a0<\/span><\/span>\u2014<\/span>\u00a0<\/span>Today,<\/span>\u00a0Sen.\u00a0<\/span><\/span><\/span>Mallory McMorrow<\/span><\/span>\u00a0(D-Royal Oak)\u00a0<\/span><\/span>testified before the Senate Civil Rights, Judiciary and Public Safety Committee on<\/span> Senate Bill 83<\/span><\/span>,\u00a0<\/span><\/span>her legislation<\/span>\u00a0<\/span>to<\/span>\u00a0allow a court to issue an \u201cExtreme Risk Protection Order\u201d (ERPO) to take temporary possession of a firearm if the court finds that an individual is at risk of harming themselves or others.<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

\u201cIn the wake of mass shooting events, the public conscience is ripped open\u2014and suddenly all of us, in small ways, get a sense of the pain, trauma, and devastation caused by gun violence every single day, in instances like these stories, the ones that don\u2019t make the headlines,\u201d<\/span>\u00a0said Sen.\u00a0<\/span><\/span><\/span>McMorrow<\/span><\/span>. \u201c<\/span>Our goal here must be to ensure that we reduce the sheer number of people whose lives are upended by gun violence so that this is not a shared experience. And extreme risk protection orders \u2014or red flag laws\u2014will save lives.\u201d<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

Sen. McMorrow\u2019s<\/span>\u00a0bill is part of a<\/span>\u00a0<\/span>broader<\/span>\u00a011-bill gun violence prevention\u00a0<\/span><\/span>package introduced<\/span>\u00a0<\/span>by<\/span>\u00a0Senat<\/span>e<\/span>\u00a0<\/span>Democrats to encourage gun safety and help prevent acts of violence like the shooting<\/span>s<\/span>\u00a0at Michigan State University<\/span>\u00a0on Feb. 13<\/span>,\u00a0<\/span>\u00a0and Oxford High School on Nov.\u00a0<\/span><\/span>30, 2021<\/span>.\u00a0<\/span>\u00a0<\/span>In addition to establishing ERPOs, t<\/span>he\u00a0<\/span><\/span>legislation<\/span>\u00a0<\/span>also<\/span>\u00a0requir<\/span>e<\/span>s<\/span>\u00a0universal background checks to close the private sale loophole<\/span>\u00a0and<\/span>\u00a0creat<\/span>e<\/span>s<\/span>\u00a0secure storage laws to keep legal firearms out of the hands of children and teens<\/span>.<\/span>\u00a0\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

\u201cRed flags laws create a preventative tool, a stopgap for loved ones, judges, and law enforcement,\u201d Sen. McMorrow said. \u201cAnd while it is difficult to measure \u2018events that did not happen,\u2019 evidence shows that these extreme risk protection orders can and do reduce suicide deaths.\u201d<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

The committee also heard supportive testimony on the legislati<\/span>ve package<\/span>\u00a0from a number of gun violence victims and family members, including students and parents from\u00a0<\/span><\/span>M<\/span>ichigan\u00a0<\/span><\/span>S<\/span>tate University.\u00a0<\/span><\/span>Attorney General Dana Nessel also spoke in support of the bills, and Oakland County Executive Dave Coulter and Oakland County Sheriff Mike Bouchard submitted written testimony in support of the gun violence pr<\/span>evention bills<\/span>.\u00a0<\/span><\/span>Oakland County Prosecutor<\/span>\u00a0Karen\u00a0<\/span><\/span>D.\u00a0<\/span><\/span>McDonald<\/span>\u00a0and<\/span>\u00a0Washtenaw County Prosecutor<\/span>\u00a0<\/span>Eli Savit testified to the importance of the bills to prevent violence and p<\/span>r<\/span>omote public safety, and emphasize the value and effectiveness of McMorrow\u2019s ERPO legislation in particular.\u00a0<\/span>\u00a0<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

Extreme Risk Protection\u00a0<\/span><\/span>Order\u00a0<\/span><\/span>laws, also known as\u00a0<\/span><\/span>r<\/span>ed\u00a0<\/span><\/span>f<\/span>lag laws, allow loved ones or law enforcement to ask a court to temporarily order the removal of guns from an individual who is at risk of harming themselves or others.\u00a0<\/span><\/span>These laws can deescalate dangerous situations and reduce gun violence, including suicides and mass shootings, while still upholding due process in the legal system.<\/span><\/span>\u00a0<\/span><\/p>\n

BACKGROUND:<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

Nineteen states and Washington, D.C. currently have Red Flag laws in place.\u00a0<\/span><\/span>According to Everytown for Gun Safety, Connecticut and Indiana experienced a reduction in firearm suicide rates following enactment of Extreme Risk laws.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

Michigan voters ranked passing a red flag law as their top priority for the new legislature according to a\u00a0<\/span><\/span><\/span>statewide Glengariff Group poll released in December 2022<\/span><\/span><\/a>. Overall, 74 percent of voters said they would support a red flag law. A national 2022 GQR Poll found that 77 percent of respondents support for allowing police, family, or household members to obtain court orders to temporarily prevent access to firearms by persons who may harm themselves or others, legislation sometimes called \u201cExtreme Risk Protection Orders.\u201d<\/span><\/span>
