Michigan is\u00a0currently one of two\u00a0states\u00a0in the U.S.\u00a0that does not\u00a0extend\u00a0Freedom of Information Act (FOIA)\u00a0access\u00a0to\u00a0the\u00a0records of the\u00a0Legislature or governor\u00a0<\/i>\u00a0<\/span>
\u00a0<\/span><\/div>\n

LANSING, Mich. (Jan. 29,\u00a02026) \u2014\u00a0Today\u00a0marks one year since the Senate passed\u00a0<\/span>critical\u00a0legislation\u00a0to expand the state’s\u00a0Freedom of Information Act (FOIA)<\/a><\/u><\/span>\u00a0to the Legislature and\u00a0governor\u2019s office.\u00a0Sponsored by Sens.\u00a0<\/span>Jeremy Moss<\/b>\u00a0(D-Bloomfield) and\u00a0<\/span>Ed\u00a0McBroom<\/b>\u00a0(R-Waucedah Twp.), Senate Bills\u00a0<\/span>1<\/a><\/u><\/span>\u00a0and\u00a0<\/span>2<\/a><\/u><\/span> would align Michigan with the majority of the country\u2019s FOIA standards, bringing much-needed transparency to state government. Despite passing with overwhelming bipartisan support, the bills have been sitting idle in the hands of Speaker Matt Hall.<\/p>\n

\u201cThis\u00a0is\u00a0an anniversary\u00a0not worthy\u00a0of a party. For a year, Matt Hall has refused to\u00a0open up access to the files in the Legislature and\u00a0governor\u2019s office \u2014\u00a0documents that would shed light on how state government decisions are made\u00a0that affect Michigan taxpayers,\u201d\u00a0said Sen.\u00a0<\/span>Moss<\/b>, Chairman of the Senate Elections and Ethics Committee. \u201cThis sweeping ethics reform passed with overwhelming bipartisan support in the Senate. With the House blocking the passage of these bills, it begs the questions: What is Matt Hall hiding from the public? How can our residents trust the state government when they\u2019re left in the dark? How can we ask our constituents to be active and civically engaged when we deprive them of resources that could better aid their understanding of how the government operates?\u201d<\/p>\n

Just days after the Senate transmitted the bills\u00a0to the House\u00a0in early 2025,\u00a0<\/span>Speaker\u00a0Hall\u00a0declared them dead on arrival and called them \u201ca very low priority\u201d<\/a><\/u><\/span>\u00a0\u2014\u00a0despite voting in favor of this very legislation in\u00a0a previous\u00a0session.\u00a0Instead of advancing\u00a0this\u00a0good-government legislation to increase accountability and transparency in the Michigan Legislature, Speaker Hall instead chose to spend the year\u00a0<\/span>blocking\u00a0legislation to lower health care costs<\/a><\/u><\/span>\u00a0for teachers and first responders;\u00a0<\/span>slow walking the 2026 budget proces<\/a>s<\/a><\/u><\/span>\u00a0and\u00a0<\/span>unilaterally axing $645 million in previously approved funds<\/a><\/u><\/span> slated for Michigan communities.<\/p>\n

Because of Speaker Hall\u2019s inaction, Michigan continues to be one of only two states\u00a0that\u00a0carve out\u00a0state lawmakers and the governor\u2019s office from being subject to records requests. This exemption contributed to the\u00a0<\/span>2015 report<\/a><\/u><\/span> from the Center for Public Integrity, which gave Michigan an F in government integrity, and the state ranked dead last \u2014 failing 10 out of 13 categories, including public access to information, executive accountability, and legislative accountability.<\/p>\n

Despite House Republicans\u2019 refusal to take up the legislation, these bills\u00a0continue to have\u00a0broad support from a diverse\u00a0and bipartisan\u00a0group of stakeholders, including the Michigan Press Association, the Mackinac Center for Public Policy, ACLU of Michigan, Progress Michigan, and Voters Not Politicians.\u00a0<\/div>\n
